The topic of garden remodelling is now back on the agenda. It is often unclear which works can be started immediately and which require planning permission. The common opinion that fences, ponds or a garden shed can be realised without a building permit is unfortunately not always true.

Cantonal building regulations

There is no general answer to the question of whether a building permit is required, as each canton has its own building regulations. If you build without a licence, you could face fines and, in the worst case, a demolition order. To avoid trouble with the municipality and neighbours, you should find out about the obligation to obtain a permit in advance.

Most cantons require authorisation

The building laws of most cantons stipulate a basic authorisation requirement for all buildings that have a fixed connection to the ground. In principle, it does not matter whether a building is to be newly erected, remodelled or used for a different purpose. Smaller construction projects are partially exempt from the authorisation requirement under cantonal law. The more extensive a building project is and the greater the interest of the public or neighbours in prior official inspection, the more likely the project is to require authorisation.

Observe building regulations

Ultimately, before any new construction or redesign of the garden, it must be checked on a case-by-case basis whether the building project is subject to the building permit requirement. Even if no building licence is required, you must ensure that all building regulations (in particular spacing rules) are observed.
